These Terms of Service (“Terms”) govern your access to and use of eventstaff.com (the “Site”) and any related online features, forms, and communications made available through the Site by [Event Staff] (“Event Staff,” “we,” “us,” or “our”).

By accessing or using the Site, submitting information through the Site, requesting a quote, or communicating with us through Site features, you agree to these Terms. If you do not agree, do not use the Site.

1) Scope and relationship to service agreements

The Site provides information about event staffing services and allows businesses to submit inquiries, request quotes, and coordinate next steps.

A separate written agreement for a specific event (for example, a services agreement, statement of work, order form, or written confirmation) will govern any staffing services we provide (a “Service Agreement”). These Terms cover Site use. A Service Agreement covers pricing, staffing counts, minimum hours, payment terms, cancellation terms, and event specific requirements. If these Terms conflict with a Service Agreement, the Service Agreement controls for the services it covers.

2) Eligibility and authority

You must be at least 18 years old to use the Site.

If you use the Site on behalf of a company or other entity, you represent that you have authority to accept these Terms for that entity. In that case, “you” and “your” refer to the entity and the person using the Site.

3) Definitions

  • “Content” means materials on the Site, including text, images, graphics, logos, and page layouts.

  • “Request” means any inquiry, form submission, message, or other communication in which you ask for information or staffing services.

  • “User Submission” means information you provide in a Request, including event details, schedules, and operational notes.

  • “Staff” means the personnel we may provide or arrange for your event under a Service Agreement.

4) Changes to these Terms and the Site

We may update these Terms from time to time. We will post the updated Terms on the Site and update the “Last updated” date. Continued use of the Site after an update takes effect indicates acceptance.

We may change, suspend, or discontinue any part of the Site at any time for operational, security, or legal reasons.

5) Privacy and communications

Our Privacy Policy describes how we collect, use, and share information. By using the Site, you agree to the Privacy Policy.

When you provide contact information, you authorize us to contact you about your Request and related operational matters by email, phone, and text message, including confirmations and scheduling updates. Marketing messages may be sent where permitted by law. You can opt out of marketing emails using the unsubscribe link. If you receive text messages and want to stop, reply STOP.

6) Acceptable use

You agree to use the Site only for lawful purposes and in a way that does not harm the Site, our business, or others.

You agree not to:

  • Submit false, misleading, or unauthorized information

  • Impersonate any person or entity

  • Access non-public areas of the Site or systems without permission

  • Introduce malware, spam, or automated traffic that disrupts the Site

  • Scrape or collect data from the Site using automated means without our written permission

  • Interfere with the Site’s normal operation or security

We may investigate suspected violations and may suspend or restrict access to protect the Site, our users, or our business.

7) Requests, quotes, and availability

Submitting a Request does not guarantee staffing availability. Availability depends on factors such as date, location, lead time, role requirements, venue constraints, credentialing, and operational complexity.

Quotes and estimates are based on information available at the time. If event details change, the quote may change. Quotes may expire if not accepted within a stated timeframe.

We may ask for additional details to provide an accurate quote, including event schedule, call times, venue access procedures, role requirements, and venue or security rules that affect staffing.

8) Booking process and Service Agreements

A binding booking occurs only when we confirm the key service terms in writing through a Service Agreement. Until then, discussions, emails, and preliminary quotes remain informational.

A Service Agreement typically covers:

  • Scope of services and role requirements

  • Event date(s), location(s), and call times

  • Staffing counts and any lead roles

  • Rates, minimum hours, and applicable fees

  • Payment terms and invoicing

  • Cancellation, reduction, and change terms

  • Conduct expectations and venue compliance requirements

9) Payments, taxes, and invoicing

If you book services, payment terms will be set out in your Service Agreement. You agree to pay amounts due according to that agreement, including any applicable taxes or pass-through charges stated in the Service Agreement.

If payment is made through a third-party payment processor, the processor’s terms may also apply. You represent that you are authorized to use the payment method you provide.

10) Client responsibilities for events

If you book services, you agree to:

  • Provide accurate event details and timely updates

  • Provide an on-site point of contact with authority to make operational decisions

  • Communicate venue rules, credentialing needs, and security screening requirements in advance

  • Provide a safe working environment consistent with applicable laws and venue policies

  • Avoid requesting Staff to perform illegal, unsafe, or materially different tasks from the agreed scope

If information is missing or conditions materially change, we may need to adjust staffing, timing, rates, or scope consistent with the Service Agreement. If conditions create safety concerns, we may pause or end services consistent with the Service Agreement and applicable law.

11) Staffing relationship and workplace standards

Staff provided under a Service Agreement remain under our direction for employment related matters. Your team provides event specific direction within the agreed scope and coordinates on-site priorities through the designated point of contact.

You agree to maintain a professional, respectful workplace environment, including compliance with applicable anti-harassment and non-discrimination laws at the event site. If serious conduct issues arise that affect safety or workplace standards, we may take reasonable steps to address them, including removing a Staff member from assignment or pausing services, consistent with the Service Agreement and applicable law.

12) On-site scope control and conduct

You agree not to direct Staff to perform work requiring licenses or certifications they do not hold, to operate specialized equipment unless explicitly agreed, or to perform tasks outside the agreed scope without prior approval.

You also agree to inform us in advance if the event includes unusual hazards or restricted areas that require special training, clearances, or protective equipment.

13) Venues and third-party constraints

Third-party venues and vendors may impose rules or delays that affect operations. You are responsible for sharing relevant venue requirements with us in advance.

We are not responsible for third-party actions outside our reasonable control, including venue delays, security line delays, outages at the venue, or changes imposed by the venue, vendors, or authorities.

14) Intellectual property

The Site and Content are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your internal business purposes, subject to these Terms.

You may not copy, distribute, modify, create derivative works of, publicly display, or exploit the Content without our written permission, except for standard browser caching and printing pages for internal reference.

“Event Staff” and related marks may be trademarks of Event Staff. Other trademarks belong to their respective owners.

15) User Submissions and feedback

You retain any rights you have in your User Submissions. You grant us a worldwide, non-exclusive license to use, reproduce, store, and process User Submissions to respond to your Request, provide services, maintain records, improve operations, and comply with law, as described in the Privacy Policy.

If you provide feedback or suggestions about the Site or our services, you grant us the right to use that feedback without restriction or compensation.

16) Confidentiality

Event planning details can be sensitive. Unless otherwise agreed in writing, each party will use reasonable care to protect confidential information shared during the inquiry and service process and will use it only for legitimate business purposes related to the event and service delivery.

Confidentiality obligations do not apply to information that is publicly available through no fault of the receiving party, independently developed without reference to confidential information, or rightfully received from a third party without restriction.

If you require a non-disclosure agreement, request one before submitting sensitive materials.

17) Third-party links and tools

The Site may link to third-party websites or use third-party tools. We do not control third-party services and are not responsible for their content, availability, or practices. Your use of third-party services is subject to their terms and policies.

18) Disclaimers

The Site is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, error-free operation, or that the Site will meet your requirements.

Site content is general information about event staffing and does not constitute legal, financial, HR, safety, or professional advice.

Event outcomes depend on many factors outside our control. We do not guarantee specific results.

19) Limitation of liability

To the fullest extent permitted by law:

  • We will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of goodwill, or business interruption, arising out of or related to your use of the Site.

  • Our total liability for claims related to the Site and these Terms will not exceed $100 or the amount you paid us for Site access, whichever is greater. If you did not pay for Site access, the cap is $100.

If you enter into a Service Agreement, liability terms for services will be governed by that Service Agreement.

Some jurisdictions do not allow certain limitations. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

20) Indemnification

You agree to defend, indemnify, and hold harmless Event Staff and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your use of the Site in violation of these Terms

  • Your User Submissions that violate law or the rights of others

  • Your misuse of the Site or interference with Site security or operations

21) Suspension and termination

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms or if necessary to protect the Site or our business.

Sections that by their nature should survive termination will survive, including intellectual property, User Submissions license, disclaimers, limitation of liability, indemnification, and dispute provisions.

22) Governing law and dispute resolution

These Terms are governed by the laws of [State], without regard to conflict of law principles.

Informal resolution: Before filing a legal claim, you agree to contact us at https://eventstaff.com/contact-us and provide a short description of the issue and the relief requested. We will attempt to resolve the dispute informally.

Venue and jurisdiction: If a dispute is not resolved informally, any legal action related to the Site or these Terms will be brought in the state or federal courts located in [County, State], and you consent to personal jurisdiction and venue there.

Optional arbitration: If you prefer arbitration instead of court, replace the Venue and jurisdiction paragraph with an arbitration clause tailored to your business and state requirements.

23) Electronic notices and records

You agree that communications and records related to the Site may be provided electronically. Notices we send by email or by posting on the Site will be treated as provided on the date sent or posted.

If we use electronic signatures for Service Agreements, you agree that electronic acceptance can form a binding agreement.

24) Miscellaneous

  • Entire agreement: These Terms and the Privacy Policy constitute the entire agreement regarding Site use.

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

  • No waiver: Failure to enforce a provision is not a waiver.

  • Assignment: You may not assign these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, or asset sale.

  • Force majeure: We are not responsible for delays or failures due to events beyond our reasonable control, including outages, natural disasters, government actions, labor disruptions, or internet failures.

  • Headings: Headings are for convenience only and do not affect interpretation.
